Badgers

Badgers are protected under the Protection of Badgers Act 1992. It is illegal to;

  • Willfully kill, injure or take a badger (or attempt to do so).
  • Cruelly ill-treat a badger.
  • Dig for a badger.
  • Intentionally or recklessly damage or destroy a badger sett, or obstruct access to it.
  • Cause a dog to enter a badger sett.
  • Disturb a badger when it is occupying a sett.

Survey and Mitigation

Where disturbance of badgers or their setts is likely, a survey and impact assessment will be required. Badger surveys can be undertaken at any time of year, although winter surveys are more effective as vegetation cover is reduced. A survey will establish the territorial boundary of a family group of badgers and the distribution and status of all the local setts.

Most types of development work within 20 metres of a badger sett will require a licence and the use of very heavy machinery which would cause ground disturbance through vibration is also likely to be licensable.

Bernwood ECS is experienced at undertaking badger surveys, and will provide you with an impact assessment and conservation recommendations to assist with your development planning. Sett destruction, exclusion and artificial sett creation may be required.
